Common use of Former Position Clause in Contracts

Former Position. An employee on layoff or transfer status due to his/her position being eliminated under this Article shall be recalled to the former position when that position is reinstated or when a consolidated position involving substantially the same duties and responsibilities is formed. When multiple employees on the recall list are qualified for a newly consolidated position, the employee with the most bargaining unit seniority will first be offered recall.

Former Position. An employee on layoff or transfer status due to his/her position or work being eliminated under this as defined in Article 16 (Staff Reduction/Layoff) shall be recalled to the former position when that position is reinstated or when a consolidated position involving substantially the same duties and responsibilities is formed. When multiple employees on formed and for which he/she is qualified, provided that such recall is within three (3) years following the recall list are qualified for a newly consolidated position, the employee with the most bargaining unit seniority will first be offered recalllayoff.
