Common use of Forms of Certificates Generally Clause in Contracts

Forms of Certificates Generally. (a) The Certificates (including the form of Purchase Contract forming part of each Unit evidenced thereby) shall be in substantially the form set forth in Exhibit 1 hereto (in the case of Certificates evidencing Corporate Units) or Exhibit 2 hereto (in the case of Certificates evidencing Treasury Units), with such letters, numbers or other marks of identification or designation and such legends or endorsements printed, lithographed or engraved thereon as may be required by the rules of any securities exchange on which the Units are listed or any depositary therefor, or as may, consistently herewith, be determined by the officers of the Issuers executing such Certificates, as evidenced by their execution of the Certificates. (b) The definitive Certificates shall be produced in any manner as determined by the officers of the Issuers executing the Units evidenced by such Certificates, consistent with the provisions of this Agreement, as evidenced by their execution thereof.

(a) The Certificates (including the form of Stock Purchase Contract Contracts forming part of each Unit Common Equity Units evidenced thereby) shall be in substantially the form set forth in Exhibit 1 hereto A (in the case of Certificates evidencing Corporate Normal Common Equity Units) or Exhibit 2 hereto B (in the case of Certificates evidencing Treasury Stripped Common Equity Units), with such letters, numbers or other marks of identification or designation and such legends or endorsements printed, lithographed or engraved thereon as may be required by the rules of any securities exchange on which the Common Equity Units are listed or any depositary therefor, or as may, consistently herewith, be determined by the officers of the Issuers Company executing such Certificates, as evidenced by their execution of the Certificates. (b) . The definitive Certificates shall be produced in any manner as determined by the officers of the Issuers Company executing the Common Equity Units evidenced by such Certificates, consistent with the provisions of this Agreement, as evidenced by their execution thereof.
