Fossils and Antiquities. The Company shall have no entitlement to any Fossils and Antiquities which may be found on, in or under any Site or in connection with the Operations. The Company shall immediately when an object which is, or might be, a Fossil or Antiquity is discovered:
12.9.1 cease work, if to continue the Operations would further endanger or disturb the object or impede its excavation or removal;
12.9.2 take all steps which may be necessary to preserve the object in the exact position and condition in which it was found and carry out examination, excavation or removal as detailed in Schedule 2 (New Works Requirements) in consultation with Historic Scotland or any successor body; and
12.9.3 inform the Contracting Authority in writing of such discovery and precise location of the object.
Fossils and Antiquities. 17.7.1 As between the parties, all fossils, antiquities and other objects having artistic, historic or monetary value and human remains which may be found on or at all the Sites are or shall become, upon discovery, the absolute property of the Authority;
17.7.2 Upon the discovery of such item during the course of the Works, the Contractor shall:
(a) immediately inform the Authority's Representative of such discovery;
(b) take all steps not to disturb the object and, if necessary, cease any Works in so far as the carrying out of such Works would endanger the object or prevent or impede its excavation; and
(c) take all necessary steps to preserve the object in the same position and condition in which it was found.
17.7.3 The Authority shall procure that the Authority’s Representative promptly, and in any event within five (5) Working Days, issues an instruction to the Contractor specifying what action the Authority’s Representative requires to be taken in relation to such discovery provided that if no instruction is forthcoming within such five (5) Working Days the Contractor may continue to carry out the Works.
17.7.4 The Contractor shall promptly and diligently comply with any instruction issued by the Authority’s Representative referred to in Clause 17.7.3 (Fossils and Antiquities) (except and to the extent that such instruction constitutes an Authority Change pursuant to Clause 17.7.6 (Fossils and Antiquities), in which case the provisions of Clause 52 (Variations) shall apply) at its own cost.
17.7.5 If directed by the Authority’s Representative, the Contractor shall allow representatives of the Authority to enter the Sites for the purposes of removal or disposal of such discovery, provided that such entry shall be subject to the Authority complying with all relevant safety procedures, which shall include any relevant health and safety plans for the refurbishment of the Dwellings from time to time and any reasonable directions with regard to site safety that may be issued by or on behalf of the Contractor’s Representative from time to time.
17.7.6 If any instruction referred to in this Clause 17.7 (Fossils and Antiquities) includes a requirement for the Contractor to suspend the carrying out of the Works and/or to carry out works (being any work of alteration, addition, demolition or extension or variation in the Dwellings and/or Properties) which are not works which would be necessary for the purpose of compliance with Legislation or any Consents, such...

12.7.2 Where the Company has ceased work pursuant to Clause 12.7.1
(a) the Company shall not recommence work until the circumstances set out in Clause 12.7.1(a) have ceased to exist or the Company has agreed with Historic Scotland that work may continue.

The Concessionaire shall take all reasonable precautions to prevent its workmen or any other persons from removing or damaging any such article or thing and shall immediately on discovery thereof and before removal inform the Government‟s Agent of such discovery and carry out such instructions as the Government‟s Agent may give as to the disposal of the same.
36.2 No extensions of time will be granted for delays nor increases in costs allowed caused by compliance with Clause 36.1 except to the extent that there shall be material delay or material Increase In the cost of the execution of the Works in which case the Government‟s Agent shall request a Government‟s Change pursuant to Clause 14.1 (Government‟s Changes].

18.11.2.3 take all necessary steps to preserve the object in the same position and condition in which it was found.

(b) Upon the discovery of such item during the course of the Works, the Concessionaire shall:
(i) immediately inform the Authority of such discovery;
(ii) take all steps not to disturb the item and, if necessary, cease any Works in so far as the carrying out of such Works would endanger the item or prevent or impede its excavation; and
(iii) take all necessary steps to preserve the item in the same position and condition in which it was found.
(c) The Authority shall promptly, and in any event within ten (10) days, issue an instruction to the Concessionaire specifying what action the Authority requires to be taken in relation to such discovery provided that if no such instruction is forthcoming within such period the Concessionaire may continue to carry out the Works.
(d) The Concessionaire shall promptly and diligently comply with any instruction issued by the Authority at its own cost.
(e) If directed by the Authority, the Concessionaire shall allow representatives of the Authority to enter the Site and/or the Leased Area (as applicable) for the purposes of removal or disposal of such discovery, provided that such entry shall be subject to the Authority complying with all relevant safety procedures.
