Common use of Fraud and Misrepresentation Clause in Contracts

Fraud and Misrepresentation. If it is found that ▇▇▇▇▇▇ has failed to report changes in circumstances, or has misrepresented to CDA the facts upon which rent is based, so that the rent being paid is less than Tenant should have been paying, then the increase in rent shall be made retroactive in accordance with Section 9.D.(3). ▇▇▇▇▇▇’s misrepresentation or failure to report changes to CDA is grounds for CDA to terminate the lease, and may subject Tenant to penalties available under state or federal law, which may include imprisonment and/or fines.
