Common use of Fraudulent Use of Services Clause in Contracts

Fraudulent Use of Services. Customer is responsible for all charges attributable to use of Customer’s Service or facilities even if incurred as the result of fraudulent or unauthorized use of Service by any person, whether such use is authorized by, or known or unknown, to Customer, except Customer shall not be responsible for fraudulent or unauthorized use by FirstLight or its employees.

Fraudulent Use of Services. Customer is responsible for all charges attributable to use of Customer’s Service or facilities Customer incurred respecting Service, even if incurred as the result of fraudulent or unauthorized use of Service by any person, whether such use is authorized by, Service; unless the charge was related to CyrusOne’s negligence or known or unknown, to Customer, except Customer shall not be responsible for fraudulent or unauthorized use by FirstLight or its employeeswillful misconduct.

In the case of Customer’s Service or facilities even if incurred as the result of fraudulent or unauthorized use of Service by any personusage-based Services, whether such use Customer is authorized by, or known or unknown, to Customer, responsible for all usage charges including services that were fraudulently obtained; except that Customer shall not be responsible for fraudulent or unauthorized use by FirstLight KFN or its employees.

Customer is solely responsible for all Service Fees and/or any other charges attributable incurred relating to use of Customer’s Service the Services, whether incurred by itself, its End Users or facilities third parties, even if such Service Fees and/or other charges were incurred through or as the a result of fraudulent or unauthorized use of Service by any person, whether such use is authorized by, or known or unknown, to Customer, except Customer shall not be responsible for fraudulent or unauthorized use by FirstLight or its employeesthe Services.
