Common use of Fundamental Research Clause in Contracts

Fundamental Research. UMD research hereunder is conducted with the intent to publish, and meets the definition of Fundamental Research as defined in National Security Directive 189 as: “[B]asic and applied research in science and engineering, the results of which ordinarily are published and shared broadly within the scientific community, as distinguished from proprietary research and from industrial development, design, production, and product utilization, the results of which ordinarily are restricted for proprietary or national security reasons.” Results of UMD research are excluded from export control due to exclusions in the laws available for fundamental research.
