(d) satisfied itself about all matters, if anythings and information hereinabove necessary and required for submitting an informed Bid, including any pre award discussion execution of the Project in accordance with the successful BidderBidding Documents and performance of all of its obligations there under;
(e) acknowledged and agreed that inadequacy, technical and other presentations etc. and lack of completeness or incorrectness of information provided in the Company Bidding Documents herein above shall not be liable a basis for any expense thereof.
3.16 If claim for compensation, damages, extension of time for performance of its obligations, loss of profits etc. from the successful Bidder is TSRTC, or a joint venture, formed of two or more companies, the Bidder along with the partners shall accept joint and several responsibilities and liabilities ground for all obligations under the Contract.

If any Bidder finds any discrepancies or omissions in the specifications and documents or any doubt in true meaning or interpretation of any part, he shall seek necessary clarifications in writing if required.
3.10 Conditional offers shall not be considered and liable to be rejected.
3.11 The Company reserves the right to extend the deadlines for submission of the Bids by giving amendments.
3.12 Bidders may visit site for detailed understanding regarding the “Scope of Work” as per the Tender document, with due prior intimation in writing pertaining to the said Site visit.
3.13 During evaluation of Bids the Company may, at its discretion ask the Bidder(s) for clarification of their Bid. The request for clarification and the response shall be in writing and no change in prices or substance of the Bid shall be sought, offered or permitted.
3.14 The Company reserves the right to amend / modify the Bidding documents at At any time prior to the deadline for submission of BidsBid, either JMRC may, for any reason, whether at its own discretion initiative or in response to the clarification clarifications requested by a prospective Bidder, modify the Bidding Document by the issuance of addenda/corrigenda.
xvi. In such caseorder to afford the Bidders reasonable time for taking an addendum/corrigendum into account, the Company may or for any other reason, JMRC may, in its discretion sole discretion, extend the deadline for Last time and date of Bid submission. It is the Bidder’s responsibility to submit the completed Bid Document taking into account all addendum / corrigendum issued.
xvii. JMRC may at its sole discretion and at any time during the processing of Bid, disqualify any bidder from the Bidding process if the bidder has:–
a. Submitted the Bid after the prescribed date and time of submission of Bids bids.
b. Made misleading or false representations in the forms, statements and attachments submitted in proof of the eligibility requirements.
c. If found to have a record of poor performance such as abandoning works, not properly completing the contract, inordinately delaying completion, being involved in litigation or financial failures, etc.
d. Submitted Bid document, which is not accompanied by required documentation and ▇▇▇▇▇▇▇ Money Deposit (EMD) or is non-responsive.
e. Failed to provide clarifications/supplemental information related thereto, when sought.
f. Submitted more than one bid.
xviii. JMRC, in its sole discretion and without incurring any obligation or liability, reserves the right, at any time, to;
a. suspend and /or cancel the bidding Process and/ or amend and/ or supplement the bidding Process or modify the dates or other terms and conditions relating thereto;
b. consult with any Bidder in order to facilitate receive clarification or further information;
c. retain any information and/ or evidence submitted to the prospective Bidders for incorporating the effect JMRC by, on behalf of, and/ or in relation to any Bidder; and/ or
d. Independently verify, disqualify, reject and/ or accept any and all submission or other information and/ or evidence submitted by or on behalf of the amendment in their Bidsany Bidder.
3.15 The Bidders xix. It shall bear be deemed that by submitting the bid, the bidder agrees and release the JMRC, its employees, agents and advisers, irrevocably, unconditionally, fully and finally from any and all costs liability for claims, losses, damages, costs, expenses or liabilities in any way related to or arising from the exercise of any rights and/ or performance of any obligations hereunder, pursuant hereto and: or in connection herewith and expenses associated with the preparation waives any and submission of their respective Bidsall rights and:' or claims it may have in this respect, to attend meetings whether actual or conferencescontingent, if any, including any pre award discussion with the successful Bidder, technical and other presentations etc. and the Company shall not be liable for any expense thereofwhether present or future.
3.16 If the successful Bidder is a joint venture, formed of two or more companies, the Bidder along with the partners shall accept joint and several responsibilities and liabilities for all obligations under the Contract.
3.17 Timely and satisfactory completion of the work and strict adherence to the allotted time frames for jobs shall be the essence of the contract.
3.18 xx. The Company JMRC reserves the right to qualify/disqualify any applicant without assigning any reason.
3.19 The Bidder shall be disqualified if any untrue statement or misrepresentation is made in the Bid formsverify all statements, attachments information and other supporting documents submitted by the BidderBidder in response to the Bid Document. Any such verification or lack of such verification by the JMRC shall not relieve the Bidder of its obligations or liabilities hereunder nor will it affect any rights of the JMRC there under.

General Instructions. 3.1 2.1 The Bidders who are interested in participating in the Tender tender must read and comply with the instructions and the Terms & Conditions terms and conditions contained in the Tender Documenttender documents.
3.2 2.2 The Bids bids shall be filled in by the Bidders tendered clearly, neatly and accurately. Any alteration, erasures or overwriting shall over-writing would be liable to make the tender invalid unless the same is neatly carried out and attested over the full signature of Biddertenderer. The decision of the Company to interpret the information and rates filled in by the Bidder tenderer shall be final and binding on the Bidderbidder.
3.3 2.3 The Bidders are requested to make themselves fully conversant with the General Conditions of Contract, Special Conditions of Contract, Technical Specifications, Site site conditions, Safety & Health Aspects safety and Norms health aspects and norms to be observed observed, etc. before while submitting their bids so that no ambiguity arises in these respects subsequent to submission of the Bids.
3.4 2.4 Before quoting the rates, the Bidder should go through the specifications, scope of work etc. and get himself fully conversant with them. The Bid bid should include cost of mobilization and cost to adhere to all Safety Norms safety norms as described in the Tendertender. No relaxation or request for revision of quoted / quoted/accepted rates shall be entertained subsequent to the opening of Bid bid on account of mobilization or Safety costs.
3.5 Splitting of work is not advisable as the purpose of SoR method will 2.5 Bidder has to quote for both Phase I & Phase II. Bids received for only one phase shall not be fulfilledconsidered. However, GIPCL reserves the rights to allot all the four units’ work to a single bidder or GIPCL may split the contract between two parties, phase-1 and phase-2 work separately as it may deem appropriate. In case of splitting of the contract between two parties, the L2 bidder shall match the rate with L1 bidder.
3.6 2.6 Bidder has to submit all the information as per and details required Bid in the bid document. Failure to furnish all the information as per required Bid bid documents or submission of a Bid bid containing deviations from the contractual terms and conditions, specifications and requirements, requirements shall be rejected.
3.7 2.7 The Bids bids shall be submitted within the time frames set out in the Notice Inviting Tender (‘NIT’) and Bids bids submitted thereafter shall not be accepted and considered.
3.8 2.8 The Tender Document tender documents shall not be transferable.
3.9 2.9 The Bidders are expected to examine all instructions, forms, terms & and specifications in the Bid bid documents and to get fully acquainted themselves with all the conditions and matters which may affect the subject matter of the work/tender or the cost thereof. Bidders may visit site for detailed understanding seek any clarifications from the Company on their written request regarding the “Scope of Work” as per the Tender tender document, with due prior intimation in writing pertaining to the said Site visit.

3.15 2.15 The Bidders shall bear all costs and expenses associated with the preparation and submission of their respective Bidsbids, to attend meetings or conferences, if any, including any pre award discussion with the successful Bidder, technical and other presentations presentations, etc. and the Company shall not be liable for any expense thereof.
