Common use of GENERAL PROGRAM OF INSTRUCTION Clause in Contracts

GENERAL PROGRAM OF INSTRUCTION. a) General Program i) All NPS/A services shall be provided consistent with the area of certification specified by CDE Certification and as defined in California Education Code section 56366 et seq. No service will be provided by the CONTRACTOR outside of the CONTRACTOR’s certification unless otherwise agreed to by the LEA. ii) When CONTRACTOR is an NPS, CONTRACTOR’s general program of instruction shall: (a) be consistent with LEA’s standards regarding required courses of study and curriculum; (b) include curriculum that addresses mathematics, literacy and the use of educational, assistive technology and transition services; (c) be consistent with CDE’s standards regarding the particular course of study and curriculum; (d) provide the services as specified in the LEA student’s IEP/IFSP and ISA. The State Standards and coursework selected for each student shall be aligned with the student’s IEP/IFSP to meet the individual student’s needs. iii) LEA students shall have access to the following educational materials, services, and programs that are consistent with each student’s individualized educational program: (a) For kindergarten and grades 1-8 inclusive, state adopted Common Core State Standards (“CCSS”) for curriculum and instructional materials; and for grades 9-12 inclusive, standards-aligned, core curriculum and instructional materials used by an LEA that contracts with the non-public, non-sectarian school;

No service will be provided by the CONTRACTOR outside of the CONTRACTOR’s certification unless otherwise agreed to by the LEA. ii) When CONTRACTOR is an NPSa nonpublic school, CONTRACTOR’s general program of instruction shall: (a) be consistent with LEA’s standards regarding required courses of study and curriculum; (b) include curriculum that addresses mathematics, literacy and the use of educational, assistive technology and transition services; (c) be consistent with CDE’s standards regarding the particular course of study and curriculum; (d) provide the services as specified in the LEA student’s IEP/IFSP and ISA. The State Standards and coursework selected for each student shall be aligned with the student’s IEP/IFSP to meet the individual student’s needs. iii) LEA students shall have access to the following educational materials, services, and programs that are consistent with each student’s individualized educational program: (a) For kindergarten and grades 1-8 inclusive, state adopted Common Core State Standards (“CCSS”) for curriculum and instructional materials; and for grades 9-12 inclusive, standards-aligned, core curriculum and instructional materials used by an LEA any local educational agency that contracts with the non-public, non-sectarian school; (b) college preparation courses; (c) extracurricular activities, such as art, sports, music and academic clubs; (d) career preparation and vocational training, consistent with transition plans pursuant to state and federal law and;
