General Requirements and Administration. 1.1. The Developer agrees that the Subject Property shall be developed and used only in accordance with and subject to the terms and conditions of this Agreement.
General Requirements and Administration. 2.1 The DEVELOPER agrees that the Property shall be developed and used only in accordance with and subject to the terms and conditions of this Agreement.
2.2 All references in this Agreement to the “Land Use By-law” are to the Municipality of the District of Yarmouth Land Use By-law (the “Land Use By-law”) or its successors.
2.3 Except as otherwise provided for herein, the development and use of the Property shall comply with the requirements of the Land Use By-law, as may be amended from time to time.
2.4 Nothing in this Agreement shall exempt or be taken to exempt the DEVELOPER or any other person from complying with the requirements of any by-law of the MUNICIPALITY applicable to the Property (other than the Land Use By-law to the extent varied by this Agreement) or any statute or regulation of the Province of Nova Scotia, and the DEVELOPER agrees to observe and comply with all such laws, by-laws and regulations in connection with the development and use of the Property.
2.5 Where the provisions of this Agreement conflict with those of any by-law of the MUNICIPALITY applicable to the Property (other than the Land Use By-law to the extent varied by this Agreement), any provincial or federal statute or regulation, any provision in the Environmental Impact Statement, or any provision in the Lease Agreement with Brazil Lake Enterprises Ltd., the higher or more stringent requirements shall prevail.
2.6 The provisions of this Agreement are severable from one another and the invalidity or unenforceability of one provision shall not affect the validity or enforceability of any other provision.
2.7 Where the context requires, the singular shall include the plural and the masculine gender shall include the feminine and neutral gender. All words appearing in this Agreement shall carry the meaning defined in the Land Use By-law, except those which may have a specific definition herein.
2.8 Where the written text of this Agreement conflicts with information provided in the Schedules attached to this Agreement, the written text of this Agreement shall prevail.
2.9 The DEVELOPER shall, upon written request, provide the MUNICIPALITY with copies of any documentation, permits or approvals required by Provincial or Federal governments or agencies.
