GENERAL REQUIREMENTS APPLICABLE TO THE MERCHANT. 2.1. Compliance with security requirements All payment terminals and payment solutions used by the Mer- chant must comply with the applicable standards established by the Card Organisations and by national legislation at any given time, and must be approved by Nets. The payment terminals must be able to read the Payment Card’s chip/magnetic stripe and must be provided with a PIN keypad. If the Merchant wishes to use a Cardholder-Activated Terminal not equipped with a PIN keypad, this requires a written approval from Nets. The Merchant is responsible for ensuring that payment termi- nals and payment solutions used to complete transactions at all times comply with the technical requirements imposed under this Agreement, including but not limited to those related to obtain- ing Authorisation for and delivery of transactions. The Merchant is required to comply with the verification proce- dures and security requirements specified by the Merchant In- structions on ▇▇▇.▇▇▇▇.▇▇/▇▇▇▇▇▇▇▇, or with such rules as Nets may otherwise have informed the Merchant of at any given time. Even if the Merchant uses 3-D Secure, all the necessary verifica- tion measures must be implemented in order to avoid fraudulent transactions, cf. Merchant Instructions at ▇▇▇.▇▇▇▇.▇▇/▇▇▇▇▇▇▇▇ The Merchant must ensure that unauthorised persons do not have access to payment terminals or payment solutions. The Merchant must inform Nets immediately of any unauthorised access or suspicion of unauthorised access to the Merchant’s sys- tems containing Card Data in case of skimming, attempted skim- ming, compromising or suspected compromising of Card Data. In the event that systems containing Card Data handled by the Merchant or by the Merchant’s external suppliers are compro- mised, or reasonable suspected to be compromised, Nets reserves the right to impose charges on the Merchant to the same extent as those imposed on Nets by the Card Organisations. The Merchant is liable for any loss or damage incurred as a result of Payment Card fraud, costs associated with the issuing of new Payment Cards, as well as costs associated with the investigation required into the security breach or a suspected breach. Such in- vestigations as well as the drafting of the associated reports must only be performed by a certified data security firm approved by the Card Organisations.   • General Requirement Any notice, election, demand, request, consent, approval, or other communication required or permitted to be given under this Contract shall be in writing signed by an officer or duly authorized representative of the party making same and shall be delivered personally or shall be sent by certified or statutory mail, postage prepaid, return receipt requested, shall be effective as of the date on which it is received or would have been received but for the refusal of the addressee to accept delivery, and shall be addressed as shown in the Contract. The persons and addresses to which notices should be given may be changed by notice given in accordance with this Article.

  • Personnel Requirements and Documentation Grantee will; 1. maintain current personnel documentation on each employee. All documents must be factual and accurate. Health-related information must be stored separately with restricted access as appropriate under Tex. Gov. Code §552.102. Training records may be stored separately from the main personnel file but must be easily accessible upon request. Required documentation includes the following, as applicable: i. A copy of the current job description signed by the employee; ii. Application or resume with documentation of required qualifications and verification of required credentials; iii. Verification of work experience; iv. Annual performance evaluations; v. Personnel data that includes date hired, rate of pay, and documentation of all pay increases and bonuses; vi. Documentation of appropriate screening and/or background checks, to include probation or parole documentation; vii. Signed documentation of initial and other required training; and viii. Records of any disciplinary actions. 2. document authentication must include signature, credentials when applicable, and date. If the document relates to past activity, the date of the activity must also be recorded. Documentation must be permanent and legible. When it is necessary to correct a required document, the error must be marked through with a single line, dated, and initialed by the writer.

  • Compliance with Environmental Requirements 50.1 The Contractor shall provide the goods and/or Services required under the Contract in accordance with applicable laws and the Authority’s environmental policy, which is to conserve energy, water and other resources, reduce waste and phase out the use of ozone depleting substances and minimise the release of greenhouse gases, volatile organic compounds and other substances damaging to health and the environment. 50.2 The Authority is committed to promoting a low carbon, high growth, global economy. The Contractor shall work with the Authority regarding any environmental or sustainability issues as the Authority considers relevant, comply with contractual obligations and carry out any reasonable request to ensure the protection of the environment, society and the economy and promotion of sustainable development and sustainable procurement throughout the Contract Period. 50.3 All written outputs, including reports, produced in connection with the Contract shall (unless otherwise specified) be produced on recycled paper containing at least 80% post consumer waste and used on both sides where appropriate. 50.4 Nothing in this Condition 50 shall relieve the obligations of the Contractor to comply with its statutory duties and Good Industry Practice.

  • Compliance with Governmental Requirements Comply with all laws, ordinances, and regulations, now or hereafter in effect, of all governmental authorities applicable to the conduct of Borrower’s properties, businesses and operations, and to the use or occupancy of the Collateral, including without limitation, the Americans With Disabilities Act. Borrower may contest in good faith any such law, ordinance, or regulation and withhold compliance during any proceeding, including appropriate appeals, so long as Borrower has notified Lender in writing prior to doing so and so long as, in Lender’s sole opinion, Lender’s interests in the Collateral are not jeopardized. Lender may require Borrower to post adequate security or a surety bond, reasonably satisfactory to Lender, to protect Lender’s interest.
