Common use of General Term and Conditions Clause in Contracts

General Term and Conditions. i. Applicants warrant that the application is their original work and that they are the owner of all the material submitted as part of their application and that the application does not infringe the intellectual property rights of any third party. ii. In the event any Applicant is selected as a MADE Student, then by submitting the application in perpetuity: a. the Applicant grants the Steering Group, jointly and severally, a worldwide, perpetual, exclusive, royalty free and transferrable licence to use, reproduce, segment, distribute, prepare derivative works of, display and communicate the report produced by the MADE Student as part of the Program (“Program Report”) in any media; b. the Applicant also grants the Steering Group, jointly and severally the right to sub-licence the rights under this licence to any third party deemed appropriate by them; c. to the extent permitted by law, the Applicant consents to the Steering Group, jointly or severally, doing anything in relation to the use of the Program Report that (but for this consent) would otherwise infringe any moral right that might exist anywhere in the world; and d. the Applicant grants the Steering Group, jointly and severally, the right to promote the Program, including the Program Report, in any media during the Program. All material used will be credited where appropriate. iii. The Steering Group reserves the right to cancel, withhold any Student position and amend these Application and Program Terms and Conditions including the Program details and the number and value of the Student positions. iv. If a MADE Student is unable to participate in the Program on the specified dates in full, then the MADE Student must advise the Steering Group as soon as is practicable and the offer by the Steering Group to the MADE Student will be withdrawn and no compensation to the MADE Student is payable. If a MADE Student withdraws from the Program after signing the Program Student Agreement, all funds paid to the MADE Student by the Steering Group must be reimbursed by the MADE Student to the Steering Group except for costs which have already been reasonably incurred as evidenced by valid receipts. v. MADE Student positions may be cancelled if the MADE Student does not comply (ie to act in accordance with) with these Application and Program Terms and Conditions or the Program Student Agreement and must refund any payment already made to the MADE Student by the Steering Group. vi. MADE Students are not agents or employees of the Steering Group. The Steering Group are not sponsors of the Students. MADE Students must not represent themselves as agents or employees of the Steering Group or members thereof or that they are sponsored by the Steering Group. vii. MADE Students are responsible for: a. making their own travel and accommodation arrangements. The host Steering Group’s Secretariat may be able to offer assistance by referral to travel and accommodation websites but the ultimate responsibility rests with the MADE Student.

The host Steering Group’s Secretariat may be able to offer assistance by referral to travel and accommodation websites but the ultimate responsibility rests with the MADE Student. b. arranging relevant insurances (including travel, medical and public liability insurance) prior to commencement of their participation in the Program and showing evidence of those insurances when asked; c. keeping abreast of any travel warnings provided via the travel advisory sites of the Australian Government Department of Foreign Affairs and Trade (▇▇▇.▇▇▇▇▇▇▇▇▇▇▇▇▇.▇▇▇.▇▇) or The Ministry of Foreign Affairs of Denmark (▇▇▇▇://▇▇.▇▇/da/rejse-og-ophold/rejse-til-udlandet/rejsevejledninger/); and obtaining all relevant visas for travel and ensuring their passport is valid for travel to and from the destination. viii. MADE Students must abide by the terms of the Student Agreement. ix. The personal information provided by the Applicant in submitting the application will be used by the Steering Group to conduct application process. By submitting an application the Applicants consent to the storage of their personal information on the Steering Group databases. MADE Students agree that the Steering Group, jointly and severally, may use this information for future promotional and marketing purposes of the MADE.
