Common use of Giving of Requests Clause in Contracts

Giving of Requests. (a) A Borrower may borrow a Loan by giving to the Facility Agent a duly completed Request. (b) Unless the Facility Agent otherwise agrees, the latest time for receipt by the Facility Agent of a duly completed Request is 9.30 a.m. (i) one Business Day (for a Loan denominated in Sterling) and (ii) three Business Days (for a Loan denominated in any other currency), in each case, before the Utilisation Date for the proposed borrowing. (c) Each Request is irrevocable.

Giving of Requests. (a) A Borrower may borrow a Loan by giving to the Facility Agent a duly completed Request. (b) Unless the Facility Agent otherwise agrees, the latest time for receipt by the Facility Agent of a duly completed Request is 9.30 11.00 a.m. (i) one Business Day before the Rate Fixing Day for the proposed borrowing (for in the case of a Loan denominated in Sterlingeuro) and (ii) three or four Business Days before the proposed Utilisation Date (for in the case of a Loan denominated in any other currency), in each case, before the Utilisation Date for the proposed borrowing. (c) Each Request is irrevocable.

(c) Each Request is irrevocable.
