Common use of Grant Funded Positions Clause in Contracts

Grant Funded Positions. Grant-Funded Employees are defined as persons employed by the College in positions that have been created specifically per the terms of a grant and with at least fifty percent (50%) of the position’s compensation package being paid by grant funds. The Board and the Union recognize that, as a condition of employment, grant-funded employees are hired only for the duration of the grant for which they work. Any and all current grant-funded employees whose employment is specifically related to a current grant as defined above shall become bargaining unit members regardless of the terms and/or monetary amount of the current grant under which they are employed, except when the employment of such an employee meets and/or exceeds the terms identified below for permanent employment. However, after the effective date of this Supplemental Agreement, a grant-funded employee shall become a bargaining unit member upon his/her three-hundred sixty- sixth (366th) day of employment, and all provisions of the CBA shall then apply to him/her. (For example, if this Supplemental Agreement becomes effective on May 29, 2010, the soonest a current grant-funded employee could become a bargaining unit member is May 30, 2011). For purposes of calculating the three-hundred sixty-five (365) consecutive days required to become a bargaining unit member, all time that an employee is out on unpaid leave or workers’ compensation shall be excluded from the calculation. Seniority for grant-funded employees that become bargaining-unit members shall be the first date that the grant-funded employee becomes a bargaining-unit member. If a former grant-funded employee is re-employed in a grant-funded position within ninety (90) days of termination of employment, the returning grant-funded employee shall be considered a continuous employee and will not be subject to re-starting the requirements to meet the three-hundred sixty-five (365) consecutive days of employment to become a bargaining unit member. They will be credited with all days worked as a grant-funded employee. If a former grant-funded employee is re-employed more than ninety (90) days after termination of employment, the returning grant-funded employee will need to meet the three-hundred sixty-five (365) consecutive days of employment to become a bargaining unit member upon his/her three-hundred sixty-sixth (366) day of employment. There shall be no bridge of service.
