Common use of Grant Not Exclusive Clause in Contracts

Grant Not Exclusive. The Franchise and the rights granted herein to use and occupy the Public Rights-of-Way to provide Cable Services shall not be exclusive, and the Township reserves the right to grant other franchises for similar uses or for other uses of the Public Rights-of-Way, or any portions thereof, to any Person, or to make any such use itself, at any time during the term of this Franchise. Any such rights that are granted shall not materially interfere with existing facilities of the Cable System or the Franchisee’s FTTP Network.

Any such rights that are granted shall not materially interfere with existing facilities of the Cable System or the Franchisee’s FTTP NetworkFranchise Agreement.

Any such rights that which are granted shall not materially interfere with existing facilities of adversely impact the authority as granted under law or this Franchise to provide Cable System or the Franchisee’s FTTP NetworkService.

The Franchise franchise and the rights granted herein in this Agreement to use and occupy the Public Rights-of-Way to provide Cable Services shall not be exclusive, and the Township City reserves the right to grant other franchises for similar uses or for other uses of the Public Rights-of-Way, or any portions thereof, to any Person, or to make any such use itselfthemselves, at any time during the term of this Franchisefranchise. Any such rights that are granted to another telecommunications provider shall not materially adversely impact the authority granted [Franchisee] under this franchise and shall not interfere with [Franchisee]’s existing facilities of the Cable System or the Franchisee’s FTTP Networknetwork.

Any such rights that are granted shall not materially interfere with existing facilities of the Cable System or the Franchisee’s FTTP Network.

The Franchise Agreement and the rights granted herein to use and occupy the Public Rights-of-Way to provide Cable Services shall not be exclusive, and the Township County reserves the right to grant other franchises for similar uses or for other uses of the Public Rights-of-Way, or any portions thereof, to any Person, or to make any such use itself, at any time during the term of this FranchiseAgreement. Any such rights that which are granted shall not materially interfere with authorize or permit physical damage to existing facilities of the Cable System or the Franchisee’s FTTP Network.

Grant Not Exclusive. The Franchise Agreement and the rights granted herein to use and occupy the Public Rights-of-Way to provide Cable Services shall not be exclusive, and the Township reserves the right to grant other franchises for similar uses or for other uses of the Public Rights-of-Way, or any portions thereof, to any Person, or to make any such use itselfthemselves, at any time during the term of this FranchiseAgreement. Any such rights that are granted shall not materially adversely impact the authority as granted under this Agreement and shall not interfere with existing facilities of the Cable System or the Franchisee’s FTTP Network.
