Common use of Grant of License to Licensee Clause in Contracts

Grant of License to Licensee. Subject to the terms and conditions of this Agreement (including Section 3.2 (Effectiveness), Section 3.3 (No Implied Rights), and Section 7.1 (Akebia Restrictions)), Akebia hereby grants to Licensee an exclusive (even as to Akebia), non-sublicensable, non-transferrable, license under the Akebia Technology to sell the Licensed Products solely to FKC in the Territory in the Field during the Term (the “License”).

Grant of License to Licensee. Subject to the terms and conditions of this Agreement (including Section 3.2 (EffectivenessEffectiveness and Suspension), Section 3.3 (No Implied Rights), and Section 7.1 (Akebia Restrictions)), Akebia hereby grants to Licensee an exclusive (even as to Akebia), non-sublicensable, non-transferrable, license under the Akebia Technology to sell the Licensed Products solely to FKC and Third Party Dialysis Organizations in the Territory in the Field during the Term Term, subject to the limitations set forth in Section 3.2 (Effectiveness and Suspension) (the “License”).
