Such term shall be renewable from time to time in accordance with the Minerals and Mining Act, 2006, (Act 703); (b) The Government hereby grants to the Company the exclusive rights to work, develop and produce gold in the Lease Area for the said term of four (4) years (including, the processing, storing and transportation of ore and materials together with the rights and powers reasonably incidental thereto) subject to the provisions of this Agreement; (c) The Company shall not, however, conduct any operations in a sacred area and shall not, without the prior consent in writing of the Minister conduct any operations: (i) within 50 yards of any building, installation, reservoir of dam, public road, railway or area appropriated for railway; (ii) in an area occupied by a market, burial ground cemetery or Government office, or situated within a town or village or set apart for, used, appropriated or dedicated to a public purpose. (d) The Company shall commence commercial production of gold within two (2) years from the date of this Mining Lease. (e) The Company shall conduct its operations in a manner consistent with good commercial mining practices so as not to interfere unreasonably with vegetation in the Lease Area or with the customary rights and privileges of persons to farm, ▇▇▇▇ and snare game, gather firewood for domestic purposes or to collect snails. (f) The public shall be permitted at their sole risk to use without charge, any road constructed by the Company in the Lease Area, in a manner consistent with good mining practices, safety and security, provided that such use does not unreasonably interfere with the operations of the Company hereunder and provided also that such permission shall not extend to areas enclosed for mining operations. Such term shall be renewable from time to time in accordance with the Minerals and Mining Law, 1986, PNDC. 153; (b) The Government hereby grants to the Company the exclusive rights to work, develop and produce gold in the Lease Area for the said term of thirty (30) years (including, the processing, storing and transportation of ore and materials together with the rights and powers reasonably incidental thereto) subject to the provisions of this Agreement;
GRANT OF MINING RIGHTS. Subject to the provisions of Article I above, Lessor, to the extent that Lessor owns and has the right to do so, hereby grants unto Lessee the right to mine and remove all of the mineable and merchantable coal hereby leased by any mining method, excluding the auger mining method, which will recover not less than eighty percent (80%) of such coal within the entire leased premises, together with all necessary and convenient rights with respect thereto, including but not limited to the following: It is understood and agreed by and between the parties hereto that the Lessee shall make a good faith, reasonable effort, to adopt and implement a mining plan which will recover no less than eighty percent (80%) of the recoverable coal on the leased premises. After having exhausted all reasonable efforts to obtain permits which will accomplish such removal percentages as are required hereunder, the Lessor agrees to consider in good faith alternate plans. In connection with any such reconsideration, Lessee shall be provided with copies of any and all documentation related to the permitting procedure for review by Lessor's Engineers.

  • Grant of Concession 2.1.1 Pursuant to the provisions of the Code and the Rules and subject to the terms and conditions of the CDA Documents, TxDOT hereby grants to Developer the exclusive right, and Developer accepts the obligation, to finance, develop, design and construct the Facility described in Section 1 of the Technical Provisions, and to enter into the Lease in the form attached as Exhibit 3 for the Facility and Facility Right of Way. 2.1.2 From and after issuance of NTP1, Developer and its authorized Developer- Related Entities shall have the right and license to enter onto Facility Right of Way and other lands owned by TxDOT for purposes of carrying out its obligations under this Agreement. 2.1.3 TxDOT and ▇▇▇▇▇▇▇▇▇ acknowledge that they have executed two counterparts of the Lease and one counter part of the Memorandum of Lease and placed them in a neutral escrow for safekeeping pursuant to the Lease Escrow Agreement. Upon the Operating Commencement Date, but not before then, and as a ministerial act, TxDOT and Developer shall date the Lease and Memorandum of Lease, obtain acknowledgment of their signatures on the 2.1.4 Developer shall have the exclusive right and obligation, during the Operating Period, to use, manage, operate, maintain and repair the Facility, and to perform Renewal Work and Upgrades, pursuant to the terms of the Lease, this Agreement, the other CDA Documents and the Principal Facility Documents. 2.1.5 Developer shall have the exclusive right and obligation, for each Facility Segment, commencing on the Service Commencement Date for such Facility Segment and ending at the end of the Term, to toll the Managed Lanes of the Facility Segment pursuant to the terms of this Agreement, the other CDA Documents and the Principal Facility Documents. 2.1.6 Developer’s rights granted in this Section 2.1 are limited by and subject to the terms and conditions of the CDA Documents, including the following: 2.1.6.1 Receipt of all Governmental Approvals necessary for the Work to be performed and satisfaction of any requirements applicable under the Governmental Approvals (including the NEPA Approval) for the Work to be performed; and 2.1.6.2 TxDOT’s sole ownership of fee simple title to the Facility and Facility Right of Way and all improvements constructed thereon, subject to Developer’s Interest, including Developer’s leasehold estate under the Lease.
