Granting of Sick Leave. An employee is eligible for sick leave with pay when unable to perform his/her duties because of illness or injury, provided that: (a) he/she satisfied the Employer of this condition in such a manner and at such time as may be determined by the Employer; and (b) he/she has the necessary sick leave credits. (a) A statement signed by the employee stating that because of illness or injury he/she was unable to perform his/her duties shall, when delivered to the Employer, be considered as meeting the requirements of 19.02(a): (i) if the period of leave requested does not exceed three (3) consecutive days; and (ii) if, in the current calendar year, the employee has not been granted more than nine (9) days sick leave wholly on the basis of statements signed by him/her. (b) Notwithstanding (a) above, in circumstances where the Employer has reason to believe that an employee is abusing sick leave, the Employer may request a medical certificate confirming the medical condition of the employee. The Employer shall copy the Union on such correspondence.
