GRATUITIES/KICKBACKS. (a) SELLER shall not offer or give a kickback or gratuity (in the form of entertainment, gifts, or otherwise) for the purpose of obtaining or rewarding favorable treatment as a LOCKHEED ▇▇▇▇▇▇ supplier. (b) By accepting this Contract, SELLER certifies and represents that it has not made or solicited and will not make or solicit kickbacks in violation of FAR 52.203-7 or the Anti-Kickback Act of 1986 (41 USC 51-58), both of which are incorporated herein by this specific reference, except that paragraph (c)(1) of FAR 52.203-7 shall not apply.

GRATUITIES/KICKBACKS. Seller warrants and certifies that neither it nor any of its employees, agents or representatives has offered or given any gratuities of any kind, nature or amount, to Buyer’s employees, agents or representatives for the purposes of securing the Agreement or securing favorable treatment with respect thereto. By accepting the Agreement, Seller certifies and represents that it has not and will not make or solicit kickbacks in violation of FAR 52.203-7. “Anti-Kickback Procedures”, or the Anti-Kickback Act of 1986 (41 U.S.C. §§ 51-58), both of which are incorporated herein by reference.

GRATUITIES/KICKBACKS. (a) Seller represents and warrants that neither Seller, including any parent, subsidiary, or affiliate of Seller, nor any of Seller’s employees, agents, or representatives, has offered or given any kickback or gratuity to Buyer’s employees, agents, or representatives with a view toward securing this Subcontract or securing favorable treatment with respect thereto. (b) Seller represents and warrants that Seller, including any parent, subsidiary, or affiliate of Seller, and all of Seller’s employees, agents, or representatives, and any other person or entity working for or on behalf of any of the foregoing (collectively, “Seller Parties”), shall comply with the provisions and requirements of the U.S. Foreign Corrupt Practices Act of 1977 as amended, and all other anti-corruption and/or anti-bribery laws, regulations, and requirements of any jurisdiction applicable to Seller. (c) By accepting this Subcontract, Seller certifies and represents that it has not made or solicited and will not make or solicit kickbacks in violation of FAR 52.203‐7 or the Anti‐Kickback Act of 1986 (41 U.S.C. § 51‐58) as amended, both of which are incorporated herein by reference, except that paragraph (c)(1) of FAR 52.203‐7 shall not apply. (d) Seller shall comply, to the extent applicable, with U.S. laws regarding boycotts, embargoes, and economic sanctions against certain countries, entities, and individuals.

By accepting this Contract, CARRIER certifies. and represents that it has not made or solicited and will not make or solicit kickbacks in violation of FAR 52.203-7 or the Anti-Kickback Act of 1986 (41 USC 51-58), both of which are incorporated herein by this specific reference, except that paragraph (c) (l) of FAR 52.203-7 shall not apply.
