GRIEVANCE ARBITRATION. For the purpose of this Agreement, a grievance or plaint is defined as a difference arising either between a member of the bargaining unit and the Hospital or between the parties hereto relating to the interpretation, application, administration or alleged violation of the Agreement. The grievance shall identify the nature of the grievance, the remedy sought, and should, where possible specify the pro- visions of the Agreement which are alleged to have been violated. At the time formal discipline is imposed or at any stage of the grievance procedure an employee shall have the right to the presence of ▇▇▇▇▇▇▇. Such complaint shall be discussed with his immediate super- visor within five (5) days after the circumstances giving rise to it have occurred or ought reasonably to have come to the attention of the employee. A meeting will be arranged with the grievor within two (2) working days of the receipt of the grievance. The employee may request and will be accompanied by granted the presence of a Union ▇▇▇▇▇▇▇. The immediate supervisor will deliver his decision in writing within five (5) days following the day on which the written grievance was presented to him. An answer will be forwarded to the written grievor within two (2) working days of the meeting. STEP 2 The parties will deliver his decision in writing arrange a meeting within five (5) working days following of completion of STEP 1. Following the day on meeting of the parties, at which meeting the Representative of the International may be present at the request of either party, an answer will be delivered to the Chief ▇▇▇▇▇▇▇ within five (5) working days of the meeting at STEP 2. If the grievance was presented is not resolved to him. This step may the satisfaction of the grievance committee, the matter will be omitted where referred to arbitration within ten (10) working days of the employee's immediate supervisor and Department Head are the same person. STEP 3 Within five (5) working days following the decision in the immediately preceding step, the grievance shall be submitted in writing to the Chief Executive Officer of the Hospital or the designated Hospital representative. A meeting will then be held between the Chief Executive Officer or the designated Hospital representative and the desig- nated union representatives who may be accompanied referral to arbitration by the general representative of the Union, within five the Company must confirm the use of a single arbitrator or a three (53) days of man board to decide the submission of the grievance at Step unless extended by mutual agreement of dispute between the parties. The decision Should a single arbitrator be agreed, the International Representative and the General Manager will meet to decide the name of the Hospital arbitrator. Should a full board be agreed, the parties will name a nominee to the board. The nominees will decide the name of the person to chair the board. The person so named to the chair will decide the date and location in which the matter will be heard as would be the case if the chair was agreed as a single arbitrator. All decisions arrived at under the foregoing procedure shall be delivered in writing within ten (10) days following final and binding on the date of such meeting. GRIEVANCE ARBITRATION. For the purpose of this Agreement, a grievance or plaint complaint is defined as a difference arising either between a member of the bargaining unit and the Hospital or between the parties hereto relating to the interpretation, application, administration or alleged violation of the Agreement. The grievance shall identify the nature of the grievance, the remedy sought, and should, where possible specify the pro- visions provisions of the Agreement which are alleged to have been violated. At the time formal discipline is imposed or at any stage of the grievance procedure procedure, an employee shall have the right to the presence of ▇▇▇▇▇▇▇. In the case of suspension or discharge, the Hospital shall notify the employee of his right in advance. Where the Hospital deems it necessary to suspend or discharge an employee, the Hospital shall notify the Union of such suspension or discharge in writing, within three (3) days. It is the mutual desire of the parties hereto that plaints complaints shall be adjusted as quickly as possible, and it is understood that an employee has no grievance until he has first given his immediate supervisor the opportunity of adjusting his complaint. Such complaint shall be discussed with his immediate super- visor supervisor within five (5) days after the circumstances giving rise to it have occurred or ought reasonably to have come to the attention of the employee. GRIEVANCE ARBITRATION. For 5.1 Any disputes or differences involving the meaning or application of this Agreement that arise between the Employer and the Union shall be resolved as provided in this Article.
5.2 All grievances, except a grievance involving a “continuing violation” for direct monetary issues, shall be brought within twenty-one (21) calendar days after the Union or Employer, as the case may be, has knowledge or should have had knowledge of the dispute.
5.3 An employee and/or Union Representative may consult directly with an Employer-Supervisor for the purpose of resolving any grievances, or on a matter that does not necessarily constitute a grievance. In any case, where the Union or the Employer is not satisfied, with respect to the disposition of a matter regarding the meaning or application of any provision of this Agreement, a grievance or plaint is defined as a difference arising either between a member of the bargaining unit and the Hospital or between the parties hereto relating to the interpretation, application, administration or alleged violation of the Agreement. A complaint or grievance arising directly between grieving party’s failure to pursue arbitration within thirty (30) calendar days following its notification to the Hospital and non-grieving party of its intention to do so, shall be considered the Union concerning grieving party’s waiver of its right to arbitrate the interpretationgrievance.
5.5 In compliance with Section 204, application or alleged violation Title II, of the Agreement Railway Labor Act, as amended, the parties shall be originated at Step within ten days following establish a System Board of Adjustment for the circumstances giving rise purpose of adjusting and deciding disputes or grievances arising pursuant to the grievance.
