Common use of Hardware and Third-Party Software Warranties Clause in Contracts

Hardware and Third-Party Software Warranties. ▇▇▇▇▇▇▇▇ warrants that, at the time of delivery, the Hardware will be new and unused. In addition, ▇▇▇▇▇▇▇▇ warrants that upon payment of the applicable fees, Customer will acquire good and clear title to the Hardware, free and clear of all liens and encumbrances. All Hardware and Third-Party Software warranties provided by the manufacturer will be passed through to Customer. ▇▇▇▇▇▇▇▇ will be solely responsible for processing and managing of all Hardware and Third- Party Software warranty claims that may be necessary during the term of this Agreement.
