HARDWARE DEVICES. The terms in this Section 12 (Hardware Devices) only apply to an order which includes a Hardware Device. 12.1. Your order may include a Hardware Device (as defined below), which You may use with the applicable Services as described in the Service Specifications. The terms of this Agreement and Your order (including those terms that refer to Services) govern Hardware Devices, the Operating System and Integrated Software (both as defined below), unless expressly stated otherwise in this Section 12, or if the terms by their nature would be inapplicable to Hardware Devices. 12.2. We provide a limited warranty for Hardware Devices as described in the Oracle Hardware Warranty available at ▇▇▇▇://▇▇▇.▇▇▇▇▇▇.▇▇▇/contracts/hardware. Any changes to the Oracle Hardware Warranty will not apply to Hardware Devices ordered prior to such change. 12.3. We provide technical support services for Hardware Devices as described in the Service Specifications and/or Oracle’s Hardware and Systems Support Policies in effect at the time the technical support services are provided (available at ▇▇▇▇://▇▇▇.▇▇▇▇▇▇.▇▇▇/contracts/hardware), as applicable. 12.4. With respect to our indemnification for Hardware Devices under Section 8, notwithstanding the provisions of Section 8.2, if we believe or it is determined that the Hardware Device (or portion thereof) may have violated a third party’s intellectual property rights, we may choose to either replace or modify the Hardware Device (or portion thereof) to be non-infringing (while substantially preserving its utility or functionality) or obtain a right to allow for continued use, or if these alternatives are not commercially reasonable, we may remove the applicable Hardware Device (or portion thereof) and refund the net book value for the Hardware Device.

HARDWARE DEVICES. GNXCOR may, in its sole discretion, (i) offer an electronic internet-enabled device (a “Device”) (such as an iPad or Amazon Echo Dot) to the Customer from time to time as part of GNXCOR’s marketing and promotional activities, or (ii) if requested by Customer, purchase a Device on behalf of the Customer, for use in conjunction with the Platform Services. The Customer acknowledges and agrees that GNXCOR does not own or control any Device, any Device provided by GNXCOR is provided “as is, where is”, GNXCOR is not responsible in any way or liable for any damages with respect to performance issues with a Device, and GNXCOR does not provide any representations or warranties whatsoever in relation to any Device. If applicable, GNXCOR will provide the Customer with the manufacturer’s warranty which accompanies the Device and the Customer acknowledges and agrees that in using a Device it will be subject to applicable terms and conditions of the Device manufacturer and its sole recourse with respect to any complaints or technical or software issues will be to the Device manufacturer.

  • Network Interface Device 2.7.1 The NID is defined as any means of interconnection of the customer’s premises wiring to BellSouth’s distribution plant, such as a cross-connect device used for that purpose. The NID is a single line termination device or that portion of a multiple line termination device required to terminate a single line or circuit at the premises. The NID features two (2) independent ▇▇▇▇▇▇▇▇ or divisions that separate the service provider’s network from the customer’s premises wiring. Each chamber or division contains the appropriate connection points or posts to which the service provider and the customer each make their connections. The NID provides a protective ground connection and is capable of terminating cables such as twisted pair cable. 2.7.2 BellSouth shall permit NewPhone to connect NewPhone’s Loop facilities to the customer’s premises wiring through the BellSouth NID or at any other technically feasible point.

  • Hardware NCR Voyix may offer you the option to purchase or subscribe to Hardware. Hardware provided may not be new but may be like-new, except for Hardware purchased from NCR Voyix, which will be new. Delivery of the Hardware will be made to your designated Licensed Site(s). All Hardware purchased by you directly from NCR Voyix or from a Reseller for use in the United States, including Alaska and Hawaii, includes a standard 30-day non-transferable warranty against defects in manufacture, beginning on the date of purchase. Damage from wear and tear, misuse and other factors are not covered.

  • Hardware and Software In order to use the Services, you must obtain and maintain, at your expense, compatible mobile hardware and software as specified by Credit Union from time to time. Credit Union is not responsible for any third party software you may need to use the Services. Any such software is accepted by you as is and is subject to the terms and conditions of the software agreement you enter into directly with the third party software provider at time of download and installation.

  • Hardware Warranty Company warrants that for a period of one (1) year from delivery of Hardware, Hardware will be free from defects in material and workmanship in normal use, but does not cover any of the following: (i) improper installation, maintenance, adjustment, repair or modification by Customer or a third party; (ii) misuse, neglect, or any other cause other than ordinary use, including without limitation, accidents or acts of God; (iii) improper environment, excessive or inadequate heating or air conditioning, electrical power failures, surges, water damage or other irregularities; (iv) third party software or software drivers; or (v) damage during shipment.

  • Software The Software is licensed to you subject to any terms and conditions presented when you downloaded it from a source authorized by NCR Voyix, as well as those contained in this Agreement. If there is a conflict, this Agreement will control. You are licensed to use the Software only with the Service and with Hardware purchased or subscribed from NCR Voyix or its Resellers. Your license to any Software will end when your subscription to the Service ends. The Software is copyrighted and licensed, not sold, and is NCR Voyix’s confidential and unpublished information. You will retain any copyright notices and proprietary legends on all copies of the Software and the media on which it is delivered. Any attempt to transfer the Software is void and will automatically cause your license to end.
