Common use of Hardware Failure Clause in Contracts

Hardware Failure. HFS will provide a toll-free telephone number for reporting Software problems. In the event that ARAC is unable to interface with the Reservation System because of hardware malfunction, and ARAC is not in default of this Agreement or the License Agreement, HFS will make good faith efforts to place reservations for ARAC through the use of other means and/or facilities.
