Common use of Hazardous Substance Clause in Contracts

Hazardous Substance. any pollutant, contaminant or any toxic, radioactive or otherwise hazardous substance, including petroleum, its derivatives, by-products and other hydrocarbons, asbestos, and toxic mold, in each case as regulated under Environmental Laws.

Hazardous Substance. Asbestos, urea formaldehyde, lead, lead paint, polychlorinated biphenyls, nuclear fuel or materials, radioactive materials, explosives, known carcinogens, petroleum products and by-products (including crude oil or any fraction thereof), and any pollutant, contaminant, chemical, material, substance or waste, defined as hazardous, toxic or dangerous or as a pollutant or a contaminant in, or the use, manufacture, generation, storage, treatment, transportation, release or disposal of which is regulated by, any toxic, radioactive or otherwise hazardous substance, including petroleum, its derivatives, by-products and other hydrocarbons, asbestos, and toxic mold, in each case as regulated under Environmental LawsLaw.

(A) Any substance that is listed, classified or regulated pursuant to any pollutantEnvironmental Law; (B) any petroleum or coal product or by-product, contaminant any waste or any toxicash, asbestos-containing material, lead-containing paint or plumbing, polychlorinated biphenyls, radioactive material or otherwise hazardous substance, including petroleum, its derivatives, by-products radon; and (C) any other hydrocarbons, asbestos, and toxic mold, substance which is regulated by any government entity in each case as regulated under connection with any Environmental LawsLaw.
