Common use of HAZARDOUS SUBSTANCES AND RESPONSIBILITY FOR ENVIRONMENTAL CONTAMINATION Clause in Contracts

HAZARDOUS SUBSTANCES AND RESPONSIBILITY FOR ENVIRONMENTAL CONTAMINATION. 32.1 Each Party will be solely responsible at it own expense for the proper handling, storage, transport, treatment, disposal and use of all Hazardous Substances by such Party and its contractors and agents. “Hazardous Substances” includes those substances: 32.1.1 included within the definition of hazardous substance, hazardous waste, hazardous material, toxic substance, solid waste or pollutant or contaminant under any Applicable Law, and 32.1.2 listed by any governmental agency as a hazardous substance. 32.2 CLEC will in no event be liable to SBC-13 STATE for any costs whatsoever resulting from the presence or release of any environmental hazard, including Hazardous Substances, that CLEC did not introduce to the affected work location. SBC-13STATE will indemnify, defend (at CLEC's request) and hold CLEC and each of its officers, directors and employees harmless from and against any Loss that arises out of or results from: 32.2.1 Any Environmental Hazard that SBC-13STATE, its contractors or agents introduce to the work locations, or 32.2.2 The presence or Release of any Environmental Hazard for which SBC- 13STATE is responsible under Applicable Law. 32.3 SBC-13STATE will in no event be liable to CLEC for any costs whatsoever resulting from the presence or Release of any Environmental Hazard that SBC- 13STATE did not introduce to the affected work location. CLEC will indemnify, defend (at SBC-13STATE's request) and hold SBC-13STATE and each of its officers, directors and employees harmless from and against any Loss that arises out of or results from: 32.3.1 any Environmental Hazard that CLEC, its contractors or agents introduce to the work locations, or 32.3.2 the presence or Release of any Environmental Hazard for which CLEC is responsible under Applicable Law.

HAZARDOUS SUBSTANCES AND RESPONSIBILITY FOR ENVIRONMENTAL CONTAMINATION. 32.1 33.1 Each Party will be solely responsible at it own expense for the proper handling, storage, transport, treatment, disposal and use of all Hazardous Substances by such Party and its contractors and agents. “Hazardous Substances” includes those substances: 32.1.1 33.1.1 included within the definition of hazardous substance, hazardous waste, hazardous material, toxic substance, solid waste or pollutant or contaminant under any Applicable Law, and 32.1.2 33.1.2 listed by any governmental agency as a hazardous substance. 32.2 CLEC 33.2 Climax will in no event be liable to SBC-13 STATE AT&T MICHIGAN for any costs whatsoever resulting from the presence or release of any environmental hazard, including Hazardous Substances, that CLEC Climax did not introduce to the affected work location. SBC-13STATE will AT&T MICHIGAN will, at Climax’s request, indemnify, defend (at CLEC's request) and hold CLEC Climax and each of its officers, directors and employees harmless from and against any Loss loss that arises out of or results from: 32.2.1 33.2.1 Any Environmental Hazard environmental hazard that SBC-13STATEAT&T MICHIGAN, its contractors or agents introduce to the work locations, or 32.2.2 33.2.2 The presence or Release release of any Environmental Hazard environmental hazard for which SBC- 13STATE AT&T MICHIGAN is responsible under Applicable Law. 32.3 SBC-13STATE . 33.3 AT&T MICHIGAN will in no event be liable to CLEC Climax for any costs whatsoever resulting from the presence or Release release of any Environmental Hazard environmental hazard, including Hazardous Substances, that SBC- 13STATE AT&T MICHIGAN did not introduce to the affected work location. CLEC Climax will (at AT&T MICHIGAN’s request) indemnify, defend (at SBC-13STATE's request) and hold SBC-13STATE AT&T MICHIGAN and each of its officers, directors and employees harmless from and against any Loss loss that arises out of or results from: 32.3.1 33.3.1 any Environmental Hazard environmental hazard that CLECClimax, its contractors or agents introduce to the work locations, or 32.3.2 33.3.2 the presence or Release release of any Environmental Hazard environmental hazard for which CLEC Climax is responsible under Applicable Law.
