3. Emergency notification and response procedures. Collection vehicle drivers shall inspect Containers before Collection when practical.

A. Inspection Program and Training. Contractor is required to inspect Solid Waste, Targeted Recyclable Materials, Organic Materials, and other materials put out for Collection and may reject Solid Waste, Targeted Recyclable Materials, Organic Materials, and other materials observed to be contaminated with Hazardous Waste and not Collect Hazardous Waste put out with Solid Waste, Targeted Recyclable Materials, and Organic Materials. Contractor shall develop a load inspection program that includes the following components: (i) personnel and training; (ii) load checking 2837 activities; (iii) management of wastes; and (iv) record keeping and emergency 2838 procedures. 2839 Contractor’s load checking personnel, including its Collection vehicle drivers, shall be 2840 trained in: (i) the effects of Hazardous Substances on human health and the 2841 environment; (ii) identification of prohibited materials; and (iii) emergency notification 2842 and response procedures. Collection vehicle drivers shall inspect Containers before 2843 Collection when practical. 2844 B. Response to Hazardous Waste Identified During Collection. Under no 2845 circumstances shall Contractor’s employees knowingly Collect Hazardous Waste or 2846 remove unsafe or poorly containerized Hazardous Waste from a Collection Container. 2847 If Contractor determines that material placed in any Container for Collection is 2848 Hazardous Waste or other material that may not legally be accepted or safely 2849 processed at the Designated Transfer and Processing Facility or presents a hazard 2850 to Contractor's employees, or those at the Designated Transfer and Processing 2851 Facility, the Contractor shall have the right to refuse to accept such material. The 2852 Generator shall be contacted by the Contractor and requested to arrange proper 2853 Disposal. If the Generator cannot be reached immediately, the Contractor shall, 2854 before leaving the Premises, leave a non-collection notice, which indicates the reason 2855 for refusing to Collect the material and lists the phone number for the San Mateo 2856 County Household Hazardous Waste Facility, or other resources as directed by 2857 Agency. Contractor’s environmental technician shall be notified to handle the issue 2858 with the Generator. The Contractor’s environmental technician shall be required to 2859 guide the Generator to safely containerizing the Hazardous Waste and shall explain 2860 the Generator’s options for proper disposition of such ma...

A. Inspection Program and Training. The CONTRACTOR shall develop a load inspection program that includes the following components: (i) personnel and training; (ii) load checking activities; (iii) management of wastes; and, (iv) record keeping and emergency procedures.
HAZARDOUS WASTE INSPECTION AND HANDLING. Contractor agrees to establish and vigorously enforce an educational program which will train Contractor’s employees in the identification and proper handling of Hazardous Waste. Contractor’s employees shall not knowingly place such Hazardous Waste in the Collection vehicles, nor knowingly dispose of such Hazardous Wastes at a Processing or Disposal Facility. If the Contractor determines that Solid Waste placed in any Container for Collection or delivered to any facility is Hazardous Waste, Infectious Waste, Excluded Materials, or other waste that may not legally be disposed of at the Disposal Facility or presents a hazard to Contractor’s employees, the Contractor shall have the right to refuse to accept such waste. The Customer will be contacted by the Contractor and requested to arrange proper disposal. If the Hazardous Waste is delivered by Contractor to a Disposal Facility before its presence is detected and the Customer cannot be identified after the best efforts of the County and Contractor to identify the Customer, the County shall arrange for its proper disposal at the expense of Contractor. This expense shall be limited to the direct disposal cost of any manifested load required to remove the Hazardous Waste. Alternatively, Contractor will have five (5) business days after receipt of written notice to make its own arrangements for the removal of the Hazardous Waste subject to County review and approval of such arrangements.

Vehicle and equipment operators shall inspect all materials prior to Disposal.
B. Response to Excluded Waste Identified at Approved Facility. Contractor’s load checkers and/or equipment operators at the Approved Facility shall inspect and identify Excluded Waste in the loads delivered by Persons, Generators, and the Authorized Collection Contractor, and such personnel shall remove these materials for storage in approved, on‐site, Excluded Waste storage Container(s) or otherwise Dispose of these materials in accordance with Applicable Law. Contractor shall arrange for removal of the Excluded Wastes at its cost by permitted haulers in accordance with Applicable Laws and regulatory requirements. Contractor may at its sole expense attempt to identify and recover the cost of Disposal from the Generator, the Authorized Collection Contractor or other Person delivering such Excluded Waste. If the Generator, the Authorized Collection Contractor or other Person delivering such Excluded Waste can be successfully identified, the cost of this effort, as well as the cost of Disposal, shall be chargeable to such Generator, the Authorized Collection Contractor or other Person delivering such Excluded Waste.
