Common use of Height Limitations Clause in Contracts

Height Limitations. ‌ The Port reserves the right to take any action it considers necessary to protect the aerial approaches of the Airport against obstructions, including the right to prevent the Airline from erecting, or permitting to be erected, any building or other structure on the Airport which, in the opinion of the Port, would limit the usefulness of the Airport or constitute a hazard to aircraft or which would otherwise fail to comply with Federal Aviation Regulations, Part 77, as such may be amended or replaced from time to time.
