Common use of Held by Warrant Agent Clause in Contracts

Held by Warrant Agent. The Warrant Agent may retain any cash balance held in connection with this Warrant Indenture and may, but need not, hold the same in its deposit department or the deposit department of one if its Affiliates; but the Warrant Agent and its Affiliates shall not be liable to account for any profit to WorldHeart or any other person or entity other than at a rate, if any, established from time to time by the Warrant Agent or its Affiliates.
