Herbicide Applications. The Parties acknowledge and agree that: (a) aerial herbicide applications for commercial forestry within the Claim Area will cease; (b) manual herbicide applications for commercial forestry within the Claim Area will not be allowed, unless such applications are approved by BRFN as an exemption; (c) manual herbicide applications for activities other than commercial forestry within the Claim Area will be considered jointly by the Province and BRFN on an application-by- application basis, considering the merits of any such requests; and (d) in instances where statutory decisions are required in respect of manual herbicide applications for activities other than commercial forestry within the Claim Area: (i) the Parties shall use best efforts to develop and present joint recommendations for the decision maker; and (ii) if there is disagreement between the Parties and/or an inability to develop joint recommendations, the Parties shall proceed to issue resolution as set forth in ARTICLE 22. Any Third Party requesting herbicide use will be encouraged to first consider non-chemical options (such as manual brushing and thinning), and if not reasonably feasible, consider targeted use only. The Province shall encourage a Third Party to use Members (or their companies) for such work.
Herbicide Applications. Upon completion of final cut at ground level on all hardwood species, apply a cut ▇▇▇▇▇ treatment herbicide approved by the Department prior to application to prevent re-growth. Apply herbicides at labeled rates and treatment recommendations immediately after final cut is performed. Apply herbicide using a blue dye additive. No additional compensation will be paid for this treatment.
