Common use of High Risk Applications Clause in Contracts

High Risk Applications. You will make reasonable business efforts to ensure that the Software is not used in any application in which the failure of the Software could lead to death, personal injury or severe physical or property damage, including, without limitation, environmental damage, (collectively, "High-Risk Applications"), including but not limited to the operation of nuclear facilities, mass transit systems, aircraft navigation or aircraft communication systems, air traffic control, weapon systems and direct life support machines, unless otherwise permitted by SKYFOUNDRY in writing. Without limiting any disclaimer of any express or implied warranty under this Agreement, SKYFOUNDRY expressly disclaims any express or implied warranty or condition of fitness of the Software for High-Risk Applications.
