HOURS OF WORK, WORK SCHEDULES AND OVERTIME. 8.01 The following is intended to define the normal hours of work for bargaining unit employees but shall not be interpreted as a guarantee of normal hours of work per day, or normal hours of work per week, or normal days of work per week nor shall this paragraph be interpreted as a guarantee that the normal hours of work will not be increased or decreased if found necessary by the Employer. The hours of work are set out only for the purpose of computing overtime. a. The regular work shift for full time employees shall be seven and one-half (7½) working hours per day exclusive of meal periods. The seven and one- half (7½) working hours per day will be worked within an eight (8) hour period. It is expected that all charge staff arrive in sufficient time prior to the start of their shift to receive report from the nurse coming off duty. Report time is not paid time. b. Shorter shifts may be regularly scheduled by the Employer of no less than two and one half (2½) hours in duration. Student dietary shifts may be of shorter duration with prior mutual agreement between Union and Employer. Private duty shifts will usually be of at least one (1) hour in duration. The Employer will schedule consecutive Private duty assignments to maximize continuous shifts where possible. 8.03 Employees who are hired to work normally less than seven and one-half (7½) hours per day or normally less than thirty-seven and one-half (37½) hours per week but more than twenty-four (24) hours per week shall be offered work in accordance with their stated availability and in accordance with the operating requirements of the Retirement Home. 8.04 Employer authorized work performed in excess of eight (8) hours a day or eighty (80) hours in a bi-weekly pay period will be counted as overtime work and will be paid for at the rate of time and one-half (1½) the employee's regular rate of pay. No overtime shall be paid to an employee who works in excess of her regularly scheduled work hours as a result of a voluntary exchange of shifts with another employee for personal convenience. It is understood where an agent of the Employer is not present to authorize overtime hours, that the designated in-charge staff person may authorize overtime work for attendants. Where the in-charge person is required to work overtime, the authorization may be approved through written request provided to the Administrator, and such request shall not be unreasonably denied. 8.05 Each employee who works five (5) or less hours shall receive one (1) fifteen (15) minute rest break with pay. Each employee who works more than five (5) hours shall receive a one-half (½) hour unpaid meal break and one (1) fifteen (15) minute rest break with pay. Each employee who works six (6) hours or more shall receive a one-half (½) hour unpaid meal break and two (2) fifteen (15) minute rest breaks with pay. The Employer will schedule all breaks so that the floor maintains coverage at all times. 8.06 There shall be no pyramiding of overtime under any provisions of this Agreement. 8.07 There shall basically be three (3) shifts scheduled each day. The first shift of the date shall be the night shift, followed by the day shift, followed by the evening shift. Changes in current shift arrangements may be introduced after consultation and input from the Labour Management Committee. 8.08 Employees have the option to take their breaks where they choose, on the premises. 8.09 The Employer shall arrange shifts so that each employee shall be scheduled every other weekend off when possible on the regular schedule. For the purpose of this Article a weekend is considered to be a Saturday and a Sunday. This Article shall not apply in cases of employee's requests or exchange of shifts by employees. 8.10 Employees may request in writing to exchange working days and off days, provided such exchange is approved by the Employer in writing two (2) business days excluding the day of submission unless there are exceptional circumstances which can be discussed with administration, and provided no employee shall, as a result, work more than (7) consecutive days. If there are scheduling difficulties, the Employer and the Union shall meet to find a mutually satisfactory solution. Private Duty shifts are excluded from the provisions of this article. 8.11 No employee shall be required to work more than two (2) different shifts in any one (1) pay period, except in case of emergency. 8.12 No employee shall be scheduled to work more than (6) consecutive days, or more than (20) twenty shifts in any four week period. Also, each employee shall have a break of at least twelve (12) hours between shifts unless mutually agreed otherwise. 8.13 The Employer shall post work schedules (excluding Private Duty assignments) on a two (2) week basis at least four (4) weeks prior to the effective day of the work schedule. No changes shall be made to the schedule after it has been posted without the express consent of the employee(s) affected. The Employer will make every effort to establish a master schedule. No overtime shall be paid to an employee who works for all hours worked: a. in excess of her regularly scheduled thirty-seven and one-half (37½) hours per week; b. in excess of seven and one-half (7½) hours in a twenty-four (24) hour pay period beginning at 11:00 p.m. on one (1) day, and ending at 10:59.59 of the next day. c. on an assigned day off when the work hours is in excess of ten (10) shifts in the two (2) week pay period, except if such work is performed as a result of a voluntary exchange of shifts switch in hours with another employee for personal convenienceemployee. 8.03 All overtime must be authorized in advance by the supervisor, and a call-in is deemed to constitute such authorization. Private Duty shifts are excluded from the provisions of this article, subject to Article 2.04. 8.11 8.09 No employee shall be required without his or her consent to work more than two (2) different shifts in any one seven (17) pay day period, except in case of emergency. 8.12 No employee shall be scheduled to work more than (6) consecutive days, or more than (20) twenty shifts in any four week period. The Employer shall post work schedules (excluding Private Duty assignments) on for a two (2) week basis calendar month not later than the 15th day of the previous calendar month. b. Employees who plan to schedule time off during the posting period must submit their request in writing to the Employer at least four (4) weeks prior to the effective day date of the work schedule. If the Employer rejects the request, the Employer will notify the employee promptly. c. No changes shall be made to in the schedule after it has been posted without gone into effect, unless there is agreement with the express consent of Employer and the employee(s) affected. The Employer will make every effort concerned and save and except in the case of absence, return from absence, discipline, lay off, recall from lay off, or scheduling lieu days pursuant to establish a master schedule. No overtime shall be paid to an employee who works for all hours worked: a) in excess of her regularly scheduled 37½ hours per week; b) in excess of 7-1/2 hours in a 24 hour pay period beginning at 11:00 p.m. on one day, and ending at 10:59.59 of the next day. c) on an assigned day off when the work hours is in excess of ten (10) shifts in the two (2) week pay period, except if such work is performed as a result of a voluntary exchange of shifts switch in hours with another employee for personal convenienceemployee. 8.03 All overtime must be authorized in advance by the supervisor, and a call-in is deemed to constitute such authorization.
