Human Experimentation. All experimentation with human subjects involving any physical or mental risk to those subjects shall be prohibited without prior written approval of the Secretary of the Department, subject to all applicable laws, statutes, and regulations including, but not limited to, 42 U.S.C. Section 3515b (relating to prohibitions on funding certain experiments involving human participants), and the voluntary, informed and written consent of each subject. If the subject is a minor or incompetent, a voluntary, informed and written consent of his or her legal guardian shall be required. The Contractor shall inform each potential subject prior to his or her consent that refusal of consent will not result in the loss of any benefits to which the subject is otherwise entitled from the federal government, Commonwealth, the SCA, or any third party insurer.
