Common use of Humidity-Level 1 Failure Clause in Contracts

Humidity-Level 1 Failure. In the event any Humidity Level 1 Failure occurs on any particular day, then Licensee's Monthly License Fees for the affected Individual Space in question shall be partially abated for that particular day by the Daily ES Abatement Amount (as defined below). The "Dally ES Abatement Amount" is defined as the Monthly License Fees for the affected Individual Space in question for that particular day, multiplied by a fraction, the numerator of which is the square footage of the portion of the affected Individual Space that is the subject of the ES Failure (as such portion Is reasonably determined by Licensor), and the denominator of which Is the total square footage of the affected Individual Space.
