Common use of Implementation Agreement Clause in Contracts

Implementation Agreement. The NCCPA requires that any NCCP Plan approved by CDFG include an Implementation Agreement that contains provisions for: • Conditions of species coverage; • Measures to ensure the long-term protection of habitat reserves and/or other conservation measures; • Implementation of mitigation and conservation measures; • Terms for suspension or revocation of the take permit; • Procedures to amend the Plan and Implementation Agreement; • Implementation of monitoring and adaptive management; • Oversight of Plan effectiveness and funding; and • Periodic reporting. While the Plans are being developed, the Parties will negotiate draft Implementation Agreements that will satisfy the requirements of the NCCPA and FESA and include specific provisions and procedures for the implementation, monitoring, and funding of the Plans. Drafts of the Implementation Agreements will be made available for public review and comment with the final public review draft of the Plans.
