Common use of Inability to Complete Clause in Contracts

Inability to Complete. Notwithstanding anything to the contrary contained in this Paragraph 17, if Landlord is obligated or elects to repair, reconstruct and/or restore the damaged portion of the Building or the Premises pursuant to subparagraphs 17.1 or 17.2 (i) above, but is delayed from completing such repair, reconstruction and/or restoration beyond the date which is sixty (60) days after the date estimated by Landlord's contractor for completion thereof by reason of any causes (other than delays caused by Tenant, its subtenants, employees, agents or contractors or delays which are beyond the reasonable control of Landlord which delays in no event shall exceed a total of ninety (90) days), then either Landlord or Tenant may elect to terminate this Lease upon ten (10) days prior written notice given to the other after the expiration of such sixty (60) or ninety (90) day period.
