Common use of Inapplicability Clause in Contracts

Inapplicability. Notwithstanding the other provisions of this article, this waiver of liability shall not be applicable to: a) Claims between a Consortium Member and its related entities; b) Claims made for payment for services rendered; c) Claims made by a natural person, his/her estate, survivors, or subrogates for injury or death of such natural person; d) Claims for damage caused by willful misconduct; or e) Intellectual property claims.
