Common use of Incidental information Clause in Contracts

Incidental information. From time to time we may, at Rakuten Securities Bullion’s discretion, provide information on Rakuten Securities Bullion’s own initiative. Where Rakuten Securities Bullion does provide market commentary, guidance or other information: (a) This is incidental to Client’s dealing relationship with us. It is provided solely to enable Client to make Client’s own investment decisions and does not amount to a personal recommendation or advice; (b) Rakuten Securities Bullion gives no representation, warranty or guarantee as to the accuracy or completeness of such information or as to the legal, tax or accountancy consequences of any transaction; (c) Where information is in the form of a document containing a restriction on the person or category of persons for whom that document is intended or to whom it is distributed, Client agrees that Client will not pass it on contrary to that restriction; (d) Rakuten Securities Bullion does not provide specific investment advice, Rakuten Securities Bullion will not advise on the merits or otherwise of Client’s transactions; (e) The decision to place a transaction is Client’s alone. Client (and not Rakuten Securities Bullion) is responsible for the effect a transaction might have on any open positions; (f) Such information may not be consistent with Rakuten Securities Bullion’s proprietary investments if any, or those of Rakuten Securities Bullion’s associates, directors, employees or agents.
