Incurrence of Indebtedness and Issuance of Preferred Stock Sample Clauses
The "Incurrence of Indebtedness and Issuance of Preferred Stock" clause restricts a company’s ability to take on new debt or issue preferred shares without meeting certain conditions. Typically, this clause sets financial thresholds or requires lender or shareholder approval before the company can borrow additional funds or create new classes of preferred equity. By imposing these limitations, the clause helps protect existing creditors and shareholders from increased financial risk or dilution, ensuring the company maintains a stable financial structure and does not overextend its obligations.
