Common use of Indemnification by Engineer Clause in Contracts

Indemnification by Engineer. The Engineer shall indemnify, defend, and hold harmless the Owner, and its officers, agents, employees, successors, and assignees from any and all claims, lawsuits, losses, and liability arising out of Engineer's failure to perform any of Engineer’s duties and obligations hereunder or in connection with the negligent performance of Engineer’s duties, obligations, or otherwise, including but not limited to any claims, lawsuits, losses, or liability arising out of Engineer’s actions.

Indemnification by Engineer. The Engineer shall indemnify, defend, indemnify and hold harmless the Owner, Client and its officers, agents, employees, successors, directors and assignees employees against and from any and all liability, loss, damage, claims, lawsuitsdemands, lossescosts and expenses, including court costs and liability reasonable counsel fees, arising out of Engineer's failure to perform personal injury or death of any of Engineer’s duties and obligations hereunder or in connection with the negligent performance of Engineer’s duties, obligationsperson, or otherwiseloss or damage to property, including but not limited only to any claimsthe extent such personal injury, lawsuitsdeath, lossesloss or damage is caused by the negligence, knowingly wrongful acts, errors or liability arising out omissions of the Engineer’s actions, its agents and/or employees.
