Independence and impartiality. (a) Unless otherwise agreed by the parties an Arbi- trator shall be and remain at all times wholly independent. (b) An Arbitrator shall be and remain wholly im- partial and shall not act as an advocate for any party to the arbitration. (c) Every person must, before accepting an appoint- ment as Arbitrator, sign and deliver to the par- ties a statement declaring that he or she knows of no circumstances likely to give rise to justi- fiable doubts as to his or her independence or impartiality and that he or she will disclose any such circumstances to the parties if they should arise after that time and before the arbitration is concluded. No Arbitrator shall be disqualified or subject to challenge by reason of one or more of the Arbitrator, counsel, party or representa- tive of a party being a member, officer or direc- tor of the Institute.
