Common use of Independent Operator Clause in Contracts

Independent Operator. The parties agree that Operator shall operate hereunder as an independent Operator as to all rights and privileges granted herein and not as an agent, representative, servant or employee of the City; that Operator shall be solely responsible for the acts and omissions of its officers, agents, Operators, Sub-Operators, servants and employees, and nothing herein shall be construed as creating a partnership or joint enterprise between the City and Operator.
