Index Data Clause Samples
The "Index Data" clause defines how reference data, such as financial indices or benchmarks, are identified and used within an agreement. It typically specifies the source, calculation method, and timing for obtaining index values, ensuring all parties refer to the same data set for performance measurement or payment calculations. This clause is essential for preventing disputes by providing clarity and consistency in how index-based terms are applied throughout the contract.
Index Data. Licensee agrees and acknowledges that the provision of Index related data (e.g. index levels, index constituents, constituent weights, etc.) to Licensee will be contracted under and governed by the relevant S&P data license agreement (the “MSA”), which is separate from this Agreement and Order Schedule, and separate fees may be payable by Licensee to S&P or its affiliates under the MSA. S&P distributes Index data directly to its clients via FTP and via third party vendors. Certain third party vendors charge S&P to distribute Index data on their platform. Licensee agrees and acknowledges that such charges may be passed through to Licensee if S&P distributes Index data via such vendor at Licensee’s direction. Any such charges as of the Commencement Date are set forth in Exhibit D.
Index Data. The Adviser has obtained all licenses and permissions necessary for the Sub-Adviser to use any index data provided to it by the Adviser or Adviser’s agent under this Agreement and the Sub-Adviser is not required to obtain any such licenses or permissions itself.
Index Data. Subject to the terms and conditions of the License Agreement and payment of the fees set forth herein, DJI Opco will provide to Licensee for use by up to five (5) individual users, via, at DJI Opco’s option, FTP Site, an authorized distributor or email delivery, the following data (collectively, the “Index Data”):
On a Daily Basis: § A list of component stocks (the “Components”) for the Licensed Index listed in this Schedule III; § Divisor of the Licensed Index as of the end of each business day; § Closing values of the Licensed Index, on a price return basis, as the end of each business day; and § Closing prices of the Components as of the end of each business day. From time to time, as appropriate: · Corporate action information with respect to the Components.

1) One-time delivery up front: - A list of component stocks (the “Components”) of the Licensed Index under this Schedule I (the “Index”); - Weightings of the Components; - Divisor of the Index.
2) On a daily basis: - Index closing values on a price-return basis. - Index divisor. - Index marketcap. - With respect to each Component: - Closing price on primary exchange; - Weighting; - Float-adjusted marketcap; - Industry group classification; - Additions; -
