Indirect and consequential losses. Subject to Clauses 10 and 25 and the exclusions in Clause 42.2, in no event shall the Contractor be liable to the Employer, including by way of indemnity, for any: (a) loss of profits; (b) loss of business or production; (c) loss of revenue; (d) loss of or damage to goodwill; (e) loss of savings (whether anticipated or otherwise); and/or (f) any indirect, special or consequential loss or damage. Mitigation 42.5 Mitigation; Each Party shall use all reasonable endeavours to mitigate any loss or damage suffered arising out of or in connection with this Agreement, including any losses for which the relevant Party is entitled to bring a claim against the other Party pursuant to the indemnities in this Agreement.
