Common use of Individual Settlement Share Calculation Clause in Contracts

Individual Settlement Share Calculation. Each Participating Class Member will receive a proportionate share of the Net Settlement Amount that is equal to: (i) the number of weeks he or she worked as a non-exempt California employee of Defendant during the Class Period, based on the Class Data provided by Defendant, divided by (ii) the total number of weeks worked by any and all Participating Class Members collectively during the Class Period based on the same Class Data, (iii) which is then multiplied by the Net Settlement Amount. One day worked in a given week will be credited as a week for purposes of this calculation. Therefore, the value of each Participating Class Member’s Individual Settlement Share is tied directly to the number of weeks he or she worked during the Class Period.
