INDIVIDUAL TEACHER CONTRACTS. A. The Board and the individual teachers will enter into individual contracts as set forth in Appendix C attached hereto and incorporated herein by reference. B. 1. The following terms and conditions shall apply with respect to the employment of each teacher. B. 2. The contract shall be renewed annually, automatically, during the period of said teacher's first three (3) years of continuous employment by said Board, unless the teacher has been notified, in writing, prior to May 10th that the contract will not be renewed for the following year. If a teacher receives a notice of non-renewal set forth in the preceding sentence, the parties agree that the teacher shall not be entitled to a statement of reasons relating to any such notice except as may be required by law. For each year for which this contract is renewed, the annual salary of the teacher shall be in accordance with the provisions of the prevailing Master Agreement between the Board and the Association. B. 3. After three (3) years of continuous employment by said Board, the contract shall continue in force from year to year, subject to the following conditions: a. It may be terminated by mutual consent at any time. b. The teacher may resign by submitting written notice to the Board not later than June 30 of the teacher's intention not to return for the ensuing year. c. The Board may terminate this contract at any time for one or more of the following reasons: (1) inefficiency or incompetence; (2) insubordination against reasonable rules of the Board; (3) moral misconduct; (4) disability, as shown by competent medical evidence; (5) elimination of the position to which the teacher was appointed, if no other position exists to which the teacher may be appointed, if qualified, or (6) other due and sufficient cause, provided prior to terminating the contract, the Board shall give the teacher a written notice that termination of that teacher's contract is under consideration and upon written request filed by the teacher with the Board within five (5) days after receipt of such notice, the Board shall within the next succeeding five (5) days give the teacher a statement, in writing, of its reasons therefore. Within twenty (20) days after receipt from the Board of written notice that contract termination is under consideration, the teacher may file with the Board a written request for a hearing, which the Board shall hold within fifteen (15) days after receipt of such request. INDIVIDUAL TEACHER CONTRACTS. All probationary teachers shall be employed by written contract, which will be signed by the teacher and by the Chairperson and Clerk of the Board of Education. Each probationary teacher shall be compensated according to the terms of his/her individual contract. Compensation shall be consistent with the specific terms and conditions of this Agreement. All continuing contract teachers shall receive an annual notice of compensation by November 15, unless a new Agreement has yet to be ratified. In this case, teachers will receive the annual notice of compensation within 60 days of Agreement ratification. The notice of compensation shall be consistent with the terms and conditions of this Agreement.
INDIVIDUAL TEACHER CONTRACTS. The School will provide an individual contract to each teacher by June 30th for the following school year. This contract will include the dates of the school year, tentative teacher assignment, and teacher salary. The contract must be signed prior to the end of June. This contract may not be terminated before its expiration date by either party without consent of both parties, or without 30 days’ notice, except as provided by law. A teacher may not use personal days after providing notice.

INDIVIDUAL TEACHER CONTRACTS. A. Individual teacher contracts shall be used in the employment of all regularly assigned members of the bargaining unit. B. The calendar year shall be the minimum number of pupil instruction (PI) days required by State law (20-1-301,MCA) plus the maximum number of State funded pupil instruction related (PIR) days. C. Additional days work for curriculum writing shall be compensated for on a salary basis. Additional compensation will be calculated at the rate of 1/186 of the base salary amount of the negotiated schedule for each day worked.

INDIVIDUAL TEACHER CONTRACTS. Section 1 - Contents of Contract: The contract shall specify the date at which the school term will begin, the term of employment, the general teaching assignment based on teacher certification, the semi-monthly wages, and the time of payment thereof. Such contract shall be signed in duplicate and one copy filed in the Office of the Business Manager and the other retained by the teacher. Such contract, including supplemental contracts, may be issued covering any period of years, not to exceed three, over which a teacher holds a certificate that will remain valid without renewal. (ref: SDCL 13-43-6). Section 2 - Supplemental Contract: (1) There shall be separate supplemental contracts for extracurricular assignments as identified on Schedule B, which are separate and apart from curricular assignments contracts. The continuing contract law shall be applicable to extracurricular/supplemental contracts for certified teachers which includes those with Authority to Act or Alternative Certification (i.e., three years of experience in an extracurricular/supplemental assignment before continuing contract (tenure) status is acquired.) All supplemental positions will be paid the first pay period following the completion of their activity with approval of administration. (2) The reassignment/transfer policy (Article XII, Section 4), is not applicable to supplemental contract area. If after four weeks of advertising a supplemental cannot be filled, the appropriate administrator may assign an individual to the supplemental contract area. In the event an individual has been assigned to a supplemental contract, he/she may write an appeal to the superintendent within seven (7) days stating the reasons for the appeal. The superintendent shall respond with a decision within seven (7) days after receiving the appeal. The response must have reasons stated by the superintendent. The decision of the superintendent may be appealed to the school board within seven (7) days after the individual receives it. The decision of the board will be final. (3) The District reserves the right to utilize individuals other than teaching staff for extracurricular/ supplemental assignments and duties.
INDIVIDUAL TEACHER CONTRACTS. All individual teachers’ contracts shall be made subject to the terms of this Agreement. The BCEA shall be notified of any new or modified individual contracts throughout the calendar year. Exceptions can be made with the mutual agreement of the BCEA and the Superintendent.
INDIVIDUAL TEACHER CONTRACTS. Each individual teacher shall be employed by written contract signed by the teacher and by the Chairman and Clerk of the School Board. Each teacher employed by the School District shall be issued an individual contract in the form provided in Appendix D-I. The compensation specified in such individual contract shall be consistent with the specific terms and conditions of this Contract. The School District and the Association mutually recognize that the discharge or other termination of the employment of teachers is governed by the provisions of the Minnesota Statutes M.S. 122A, as amended, and is not subject to the grievance and arbitration provisions of this Contract. Except for an emergency, any teacher desiring to resign at a time not specifically authorized by M.S. 122A shall submit to the Director of Human Resources a resignation and request for release from contract not less than thirty (30) days prior to the date on which the release is to be effective. A release from contract will be granted if the School District is able to secure an acceptable replacement.
