Common use of Infiltration Clause in Contracts

Infiltration. BMPs shall be designed, installed, and maintained to infiltrate runoff in accordance with the following requirements. Exemptions and Prohibitions addressing both source locations and BMP treatment locations are located in section 16.06(5). (1) Development Disturbing One (1) or More Acres (i) New Development with 10% to 40% Connected Imperviousness. Practices shall be designed to infiltrate sufficient runoff volume so the post-developed infiltration volume shall be at least 90% of the pre- development infiltration volume, based upon average annual rainfall. However, when designing appropriate infiltration systems, no more than 1% of the site is required to be used as effective infiltration area. (ii) New Development with More Than 40% and Up to 80% Connected Imperviousness. Practices shall be designed to infiltrate sufficient runoff volume so that the post development infiltration volume shall be at least 75% of the pre-development infiltration volume, based on an average annual rainfall. However, when designing appropriate infiltration systems, no more than 2% of the site is required to be used as effective infiltration area.
