Common use of Information from Third Parties Clause in Contracts

Information from Third Parties. Where technical data and information relating to any developments or improvements of the Products is legally obtained or obtainable from an unrelated party only upon payment, there shall be no obligation on either party hereto to make such payment in order to obtain such technical data and information for disclosure to the other party, PROVIDED, HOWEVER, that if the party does make such payment, such technical data and information shall be disclosed to the other party.
