Common use of Inherently Dangerous Applications Clause in Contracts

Inherently Dangerous Applications. The LICENSED PRODUCT is not specifically developed or licensed for use in the planning, construction, maintenance, operation or other use of any nuclear facility, or for the flight, navigation or communication of aircraft or ground support equipment, or for military use, medical use or in any other inherently dangerous activity. Licensee agrees that MoSys shall not be liable for any claims, losses, costs or liabilities arising from such use if Licensee, its SUBSIDIARIES, or its/their distributors or customers use the LICENSED PRODUCT for such applications. Licensee agrees to indemnify and hold MoSys harmless from any claims, losses, costs, and liabilities arising out of or in connection with the use of the LICENSED PRODUCT or LICENSED INTEGRATED CIRCUITS in any such applications.
