Common use of Initiation of Procedures Clause in Contracts

Initiation of Procedures. Any party wishing to initiate the dispute resolution procedures set forth herein with respect to a Dispute not resolved in the ordinary course of business, shall give written notice of the Dispute to the other parties and of its initiation of the negotiation procedure set forth in Section 12.10.1(c) below (the “Dispute Notice”). The Dispute Notice shall include (a) a statement of that party’s position and a summary of arguments supporting that position, and (b) the name and title of the executive who will represent that party, and of any other Person who will accompany the executive, in the negotiations under Section 12.10.1(c) below.
