Common use of Injunction, Litigation, etc Clause in Contracts

Injunction, Litigation, etc. No temporary restraining order, preliminary or permanent injunction or other order issued by any court of competent jurisdiction or other legal restraint or prohibition preventing the consummation of the Merger shall be in effect; provided that prior to invoking this condition the Company shall use its good faith efforts to have any such decree, ruling, injunction or order vacated.
