Insolvency of Foreign Custodians. The Custodian shall be responsible for losses or damages suffered by the Funds arising as a result of the insolvency of a Foreign Custodian only to the extent that the Custodian failed to comply with the standard of care set forth in Article II with respect to the selection and monitoring of such Foreign Custodian.
